Email your Democratic Senator and Tell Them to Unrig the Courts

It’s up to our Democratic Senators to take action to rebuild a functioning democracy.

Our judicial system is not doing great. Despite the fact that over 160 of President Biden’s judicial nominees have been confirmed to the federal bench,

SCOTUS has continued its assault on our fundamental rights. It was not enough to overturn abortion rights in 2022 – they went on to overturn affirmative action and allow businesses to discriminate against LGBTQ+ people. And that’s on top of the highly questionable and corrupt behavior that some justices have exhibited off the bench.

At the same time, Senate Republicans have been using an archaic Senate rule known as the “blue slip” to veto President Biden’s pro-democracy nominees for federal courts. They’re holding that if they can keep these vacancies open long enough, a Republican can fill them with anti-democratic MAGA judges instead.

We need the Senate to act now to protect democracy and restore legitimacy and trust to the courts. Reach out to your Senator today and ask them to fulfill our Fair Courts Wish List, which includes:

1. Cosponsoring the Supreme Court Ethics, Recusal, and Transparency Act (SCERT) to create enforceable ethical guidelines for SCOTUS and a binding code of conduct for justices

2. Cosponsoring the Judiciary Act to save our constitutional and civil rights by adding four seats to SCOTUS

3. Eliminating the use of blue slips so MAGA Republicans can’t obstruct filling all federal bench vacancies with pro-democracy judges by the end of 2024

I’m a constituent from [REPLACE: your state] and I am incredibly worried about the state of our democracy and judicial system.

The Supreme Court has been stacked with a MAGA majority who are beholden to special interests and the Republican Party. Given their repeated attacks on our fundamental rights and continued unethical behavior off the bench, I have lost confidence that the Supreme Court is a fair arbiter of justice that will uphold my constitutional rights. At the same time, Republicans in the Senate have repeatedly used the blue slip rule to block President Biden’s judicial nominees, preventing the Senate from confirming pro-democracy judges to the vacancies on the federal bench. This is unacceptable and this archaic rule should be eliminated.

To that end, I urge the Senator to protect our courts and our democracy by taking the following steps:
1. Cosponsoring S.359, the Supreme Court Ethics, Recusal, and Transparency Act (SCERT), to create meaningful and enforceable ethical guidelines for Supreme Court Justices.
2. Cosponsoring S.1616, the Judiciary Act, to save our constitutional and civil rights by adding four seats to the Supreme Court. 
3. Opposing the continued use of blue slips in order to fill all federal bench vacancies with pro-democracy judges by the end of 2024.

All three steps are necessary to restore legitimacy to the courts and reestablish trust in the institution. I expect that the Senator will act to save our rights and our democracy and will be paying close attention to this issue as we move into the new year.
